Australia’s Securities Regulator Victorious in Case Against Local Operator of Kraken
Australia’s securities regulator, the Australian Securities and Investments Commission (ASIC), has emerged triumphant in a case against Bit Trade Pty Ltd, the operator of cryptocurrency exchange Kraken in the country. The Federal Court of Australia ruled in favor of ASIC, determining that Bit Trade had contravened a section of the Corporations Act related to its margin extension product. The court found that Bit Trade had failed to make a target market determination before offering the product to consumers, as required by Section 994B of the Corporations Act.
In response to the ruling, a spokesperson for Kraken expressed disappointment but affirmed the company’s willingness to comply with the court’s decision. The spokesperson also highlighted the complexities of applying existing regulatory frameworks to innovative technologies.
The court judgment shed light on the regulatory landscape for crypto offerings in Australia. Kraken’s legal spokesperson mentioned that the law regarding crypto offerings in the country is unclear. The court found that Kraken’s margin offering falls under the Design and Distribution Obligations regulations when extending fiat currency to clients, but not when extending cryptocurrency. Kraken intends to promptly comply with the court’s decision and continue serving its customers.
ASIC has indicated that it will seek financial penalties against Bit Trade, and both parties have been given seven days to agree upon declarations and injunctions. The regulator views the outcome as significant, asserting that it sends a message to the crypto industry that product compliance with regulatory obligations is essential in protecting consumers.
