Do Kwon obtained new bail conditions in Montenegrin court

The Court of First Instance of Montenegro granted the bail petition of Terra co-founder Do Kwon and former CFO Han Chan-Jun on modified terms.

Bail of 400,000 euros for Do Kwon and technical director Han Chang-Joon has been approved again by the Montenegrin Court of First Instance, attorney Branko Anđelić said.<br

The trial court took into account the seriousness of the criminal offense, the personal and family circumstances of the defendants, as well as the financial situation of those posting bail. In addition, the court will verify the authenticity of the documents and identification cards, as Kwon’s lawyer argued that the Costa Rican passports were legally obtained.

The court ordered Kwon and Chan-joon to remain in the apartment at the address given by their attorney, Branko Angelic, until the passport forgery case is concluded. If the defendants abscond or violate the measures imposed, the court will revoke their bail and the amount will be added to the court’s budget. The Montenegrin prosecutor’s office has three days to appeal the decision. If there is no appeal, the court will release the defendants on bail on new terms.

The Montenegrin court of first instance’s previous decision to release the defendants on bail totaling 800,000 euros was overturned by Montenegro’s highest court on May 24. Montenegrin Prosecutor’s Office previously appealed the court’s decision to release Do Kwon and Han Jang-joon on bail. According to the prosecutor’s office, the amount of bail is insufficient to prevent the risk of the accused fleeing.

Kwon hid from Interpol for several months before he was arrested at the airport in the Montenegrin capital on March 23. Law enforcers said a Korean businessman tried to travel on a rented private plane with a fake passport. The U.S. and South Korea are charging Kwon with multiple fraud charges for his alleged role in the Terra collapse last spring.
