While the court dismissed the claim that O’Neal had significant control over the project, it did not dismiss the claim that he acted as a seller by soliciting the purchase of Astrals products. Additionally, the court found that the tokens sold by Astrals may be considered unregistered “securities.” This ruling may bring clarity to other ongoing crypto class action lawsuits. O’Neal and the Astral project have until September 12, 2024, to respond to the allegations. O’Neal has not provided a comment on the matter.
